Waiver and Release of Liability

IMPORTANT: This is a legal document that affects your rights. Read it carefully before signing.

1. Definitions

Guest: A person who receives services, tours, or participates in activities organized by Península Project.
Activities:
Include transportation, cenote visits, cultural experiences, meals, and other tourist or recreational activities.

2. Voluntary Assumption of Risk

The Guest acknowledges that participation in Activities involves inherent risks, including but not limited to:

  • Injuries or accidents in cenotes
  • Transportation-related incidents
  • Adverse food or drink reactions



Guest declares that participation is voluntary and assumes full responsibility for any risk, whether known or unknown.

3. Cenotes

Cenote visits involve specific risks, such as:

  • Slips, falls, or drowning
  • Uneven or slippery terrain and limited access
  • Sudden changes in water temperature or visibility
  • Wildlife or natural plant life



Guest confirms they are medically and physically fit for water activities.

4. Transportation

Activities may include travel by van or vehicle on rural or urban roads.
Possible risks include:

  • Traffic collisions or accidents
  • Adverse weather conditions
  • Mechanical breakdowns or delays



Guest confirms they have no medical condition that would impair safe participation in transportation.

5. Food and Drinks

Guest acknowledges that some meals may include regional ingredients and potential allergens. Guest confirms that:

  • They have no known allergies OR
  • They have informed staff of any allergies or dietary restrictions in advance.

6. Release of Liability

Guest releases and discharges Península Project, its staff, and collaborators from any liability for injury, illness, property damage, loss, or death arising from participation in Activities, except in cases of proven gross negligence.

7. Medical Insurance

Península Project does not provide medical or personal accident insurance.
Guest is responsible for having personal insurance coverage during participation.

8. Personal Belongings

Guest is solely responsible for their personal property.
Península Project will not be liable for any loss, theft, or damage to personal belongings during Activities.

9. Media Release

Guest grants permission to Península Project to take and use photographs, videos, or recordings made during Activities for promotional purposes, including social media, websites, or brochures.
No financial compensation will be provided.

10. Governing Law

This waiver is governed by the laws of the State of Yucatán, Mexico.
If any clause is found to be invalid or unenforceable, the remaining provisions shall remain in full effect.

11. Circumstances Beyond Control

Península Project is not responsible for any consequences resulting from incorrect or incomplete information provided by the Guest at the time of booking, including but not limited to incorrect email addresses, phone numbers, hotel names, or pickup locations.


Additionally, Península Project shall not be held liable for delays, alterations, or cancellations resulting from factors outside its control, including but not limited to:

  • Weather conditions
  • Road closures or traffic delays
  • Acts of nature (such as flooding, insects, or animals)
  • Mechanical or electrical failures
  • Government restrictions or destination closures
  • Overcrowding at venues or any logistical disruptions


Península Project will make reasonable efforts to proceed with planned activities, but cannot guarantee unchanged itineraries.


Guests acknowledge and agree that any personal expenses incurred due to changes, cancellations, or delays (such as costs related to flights, hotels, meals, transportation, or missed reservations) are solely their responsibility.

12. Acknowledgment of Understanding

The Guest confirms that they have provided accurate personal and health information and will follow all instructions from Península Project staff during the Activities.

The Guest understands that failure to follow safety guidelines, staff instructions, or responsible behavior may result in immediate removal from Activities without refund.
